Thorn in the restaurant industry’s side Mamion Kirschenbaum announces today that he is representing teams from two separate NYC dining establishments in class action wage-related lawsuits.
First up: Alphabet City hot spot Babu Ji. The suit alleges that owners Jessi and Jennifer Singh pocketed tips that were meant for their employees and did not pay them adequate overtime compensation. The suit notes: "Defendants’ pattern, practice, and policy of stealing from their employees has violated their employees’ rights under the FLSA and New York Law." The damages have yet to be assessed. Next up: Dean Poll’s Theater District steakhouse Gallaghers. The suit claims that the management "misapplied the tip credit" to employee wages, and also shortchanged the workers on hours and overtime pay. The plaintiffs are seeking unspecified damages. You can check out the full lawsuit here.
Both suits were filed today. In the past, Maimon Kirschenbaum has lobbed similar lawsuits on behalf of restaurant teams from Le Bernardin, Dinex, '21' Club, the Batali Empire, Brother Jimmy's, and Artisanal, to name a few.
