The large soda ban that former Mayor Michael Bloomberg championed during his last years in office is officially dead. New Yorkers can drinks as many big sodas as they want in restaurants, movie theaters, ballparks — everywhere and anywhere, really.
A state judge shot the proposal down a year and a half ago, and a state appeals court also rejected the plan last summer. But the final nail was hammered into the coffin today, when New York's highest court announced that it would not reinstate the ban. A statement from the court notes: "The Board of Health engaged in law-making beyond its regulatory authority...It is clear that the Board of Health wrote the Portion Cap Rule without benefit of legislative guidance." This was the city's last chance to get the ban reinstated.
